Terms and conditions of use and sale
1. Preamble and acceptance
These General Terms and Conditions of Use and Sale (hereinafter the "Terms") govern access to and use of the KEKE BÉNIN mobile digital platform (hereinafter the "Application").
By downloading, creating an account, or using the Application, you accept these provisions in full and without reservation. If you do not accept these Terms, you must stop using the Application immediately.
2. Definitions
- Application: The KEKE BÉNIN mobile platform available on iOS and Android.
- Services: All the matchmaking and intermediary features offered by the Application.
- User: Any individual or legal entity who downloads and uses the Application to book a ride.
- Driver: An independent service provider carrying passengers or goods aboard a three-wheeled vehicle (kéké).
- Ride: The transport service provided by a Driver to a User through the Application.
3. Description of the Service
KEKE BÉNIN is a technology platform that connects Users and Drivers. It allows Users to find and book rides with nearby independent Drivers.
Important note: KEKE BÉNIN is not a public or private transport company. KEKE BÉNIN does not own any vehicle and does not directly provide transport services. Responsibility for transport lies exclusively with the independent Driver.
4. Access requirements
To use the Application, you must:
- Be at least 18 years old or have valid parental authorization.
- Create a personal account by providing a valid phone number and accurate information.
- Keep your access credentials confidential.
KEKE BÉNIN reserves the right to suspend or close any account containing false, suspicious, or fraudulent information.
5. Payments
5.1 Pricing
The estimated price of the Ride is calculated and displayed before the booking is confirmed, based on a flat rate or the estimated distance.
5.2 Payment methods
Payment for Rides is made using the options offered in the Application:
- In cash, directly to the Driver at the end of the ride.
- By Mobile Money (MTN MoMo, Moov Money), directly through the Application.
- Through the built-in virtual wallet (KEKE BÉNIN Wallet).
5.3 Cancellation
The User may cancel a ride. Compensatory cancellation fees may apply if the cancellation occurs after the Driver has accepted and started heading to the pickup point.
6. User obligations
The User agrees to:
- Behave respectfully and courteously toward the Driver.
- Not transport illegal, dangerous, or unsanitary goods.
- Respect the maximum passenger capacity allowed by the vehicle.
- Be liable for any damage caused to the Driver's vehicle through their own fault.
7. Partners
Drivers listed on the Application are independent partners and not employees of KEKE BÉNIN. They are solely responsible for the validity of their driving licenses, circulation permits, administrative documents, and vehicle insurance required by the regulations in force in Benin.
8. Intellectual property
All elements of the Application (logos, trademarks, text, design, graphical interfaces, source code) are the exclusive property of KEKE BÉNIN. Any unauthorized reproduction, modification, or reuse is strictly prohibited.
9. Availability and support
KEKE BÉNIN strives to ensure maximum availability of the service. However, access may be temporarily interrupted for maintenance, technical updates, or network/telecom outages beyond our control.
Customer support is available directly through the Application to report any malfunction or complaint related to a ride.
10. Limitation of liability
KEKE BÉNIN acts strictly as a technical intermediary. Accordingly, KEKE BÉNIN disclaims all liability for:
- Driver delays caused by traffic or weather conditions.
- Behavior, misconduct, or offenses committed by the Driver or the User.
- Items left behind or damaged in vehicles (although support will try to help recover them).
- Bodily injury or property damage occurring during the Ride, which is the responsibility of the Driver and their insurance.
11. Privacy and personal data
KEKE BÉNIN collects only the data strictly necessary for the service to function (phone number, location data for ride assignment, ride history).
This information is never sold to third parties. It is processed in compliance with the personal data protection laws in force in the Republic of Benin. Users have the right to access, correct, and delete their data simply by contacting support.
12. Changes to these Terms
KEKE BÉNIN may revise these Terms at any time to adapt its service to legal or technical developments. Users will be informed of major updates directly within the Application. Continued use of the service after a change constitutes acceptance of the new Terms.
13. Force majeure
KEKE BÉNIN cannot be held liable for any suspension or interruption of the service resulting from a case of force majeure (natural disasters, government decisions, general strikes, major internet or telecom network outages).
14. Miscellaneous provisions
If a clause of these Terms is declared void or unenforceable by a court decision, the remaining clauses will retain their full force and effect.
15. Governing law and dispute resolution
These Terms are governed by the law of Benin.
In the event of a dispute, the User and KEKE BÉNIN agree to seek an amicable solution before taking any legal action. Failing an amicable agreement within 30 days, the competent courts of Cotonou shall have sole jurisdiction to settle the dispute.
